Our aim is to provide you with advice, services and information. All this in perfect confidentiality and security both in the nature of your purchases and in the way you manage your order and payment.
These General Terms and Conditions of Sale shall prevail over all other conditions contained in any other document, unless otherwise agreed in advance, expressly and in writing.
3. ACCEPTANCE AND APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

(8) the buyer chooses a payment method; in the case of payment by credit card the buyer confirms the transaction on a secure page
(9) the buyer receives an e-mail confirming the details of his order with the description of the products ordered, quantities, prices of the products and transport as well as instructions concerning the possible payment of his order.
However, an order only becomes final after (1) confirmation of the preparation of the order by MY SIEGE A MOI ( EIRL Bruno DUVAL) (an e-mail is then sent to the Internet user to confirm the preparation or manufacture of his order) and (2) after receipt by MY SIEGE A MOI ( EIRL Bruno DUVAL) of the full price.
The products offered for order are valid within the limits of the stocks of raw materials or finished products available at the warehouse MON SIEGE A MOI ( EIRL Bruno DUVAL), at suppliers or manufacturers. If the product is not in stock and the time limit is not indicated on the site when ordering or if the availability of the product is incorrect, an email is sent to the buyer as soon as possible to inform him of the new delivery time.
As soon as the order is ready to be shipped, an email is sent to the buyer. In the case of a delivery with appointment booking, the buyer is contacted by the carrier or is invited to connect to the carrier's website for an appointment booking.
A detailed delivery note is attached to the package. If part of the order could not be delivered, the remaining quantities are indicated on the delivery note. When the order is shipped, an invoice can be downloaded in the "my account" section on the website.

The information given by the buyer when placing his order is only binding on him. In the event of an error in the statement of his contact details, the seller cannot be held responsible for the impossibility of delivering the products.
MON SIEGE ( EIRL Bruno DUVAL) reserves the right to verify the personal data provided by the customer and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the person holding the customer account and/or the means of payment used, in order to avoid any identity theft or fraudulent payment.
MON SIEGE ( EIRL Bruno DUVAL) therefore reserves the right to refuse or cancel any order from a customer, in particular in the event of the insolvency of the said customer, in the event of a non-payment of the order concerned, a non-payment of a previous delivery or a dispute relating to the payment of a previous order.
The quotations proposed by MON SIEGE A MOI ( EIRL Bruno DUVAL) are valid for a period of 15 days.
A minimum order of 15€ including VAT is required.
5. PRICE
The prices displayed by default on the site are indicated in euros all charges included applicable in Metropolitan France and Corsica. Once the Internet user has specified the delivery address, the prices will appear exclusive of tax for deliveries outside the EEC and for the French overseas departments and territories.

7. AVAILABILITIES
In accordance with article L 111-1 of the French Consumer Code, MON SIEGE A MOI ( EIRL Bruno DUVAL) endeavours to present as best as possible, on the technical data sheets of the products, the essential characteristics of the latter of which the customer must be aware.
Unless otherwise specified on the monsiegeamoi.comt website, all products sold by MON SIEGE A MOI ( EIRL Bruno DUVAL) comply with European legislation and French standards in force.
Our product and price offers are valid as long as they are visible on the site, within the limits of the stocks of finished products or available raw materials. For products not stored in our warehouses, our offers are valid subject to availability from our suppliers. In this context, information on the availability of products is provided at the time of placing the order. This information comes directly from our suppliers, errors or modifications may exceptionally exist.
In the event of unavailability of the ordered product, in particular due to our suppliers, MON SIEGE ( EIRL Bruno DUVAL) undertakes to inform the customer as soon as possible after confirmation by the suppliers of the reasons and duration of this unavailability.
In the event of an order for an item that proves unavailable, monsiegeamoi.com reserves the right to cancel the order, subject to notifying the user.
In this case, the customer has the option of requesting either reimbursement of the sums debited from his bank account or, subject to agreement between the parties, the replacement of certain items with items of similar or better quality at a price equal to or higher.
Refunds can be made by bank transfer or cheque, at the latest within 15 days after full or partial cancellation of the order by either party.
In the event of an order for several products, if one of the products proves unavailable within the time limits announced on the site, MON SIEGE ( EIRL Bruno DUVAL) will then inform the buyer of the time limit. The order can then be shipped by MON SIEGE AT ME ( EIRL Bruno DUVAL) even if all the products of this order are not available. The buyer will then only be invoiced for the shipping costs announced at the time of the order.
If no delivery date is communicated to you, MON SIEGE A MOI ( EIRL Bruno DUVAL) is required to deliver no later than 30 working days from the date of validation of the order.
As information on the availability of finished products is transmitted by our suppliers, the unavailability of products cannot engage the responsibility of MON SIEGE TO ME ( EIRL Bruno DUVAL), nor can it give rise to any claim for damages for the customer.
Spare parts for chairs are available at least two years after the invoice date. If a part is unavailable, a part offering the same functionality could be offered to you.
8. DELIVERY
The products are delivered to the delivery address indicated by the customer when ordering. MON SIEGE A MOI ( EIRL Bruno DUVAL) cannot be held responsible for a delayed or cancelled delivery due to an incorrect or incomplete address. In this case, and/or in the event of the return of the goods to our warehouses, MON SIEGE MON SIEGE ( EIRL Bruno DUVAL) will also invoice the customer for the costs of second presentation or suffering without the customer being able to object.
Concerning delivery in local shops, it may happen during periods of high activity or special events that parcel relays are saturated or inaccessible. The parcel can therefore be delivered in another parcel relay than the one initially chosen and MON SIEGE ( EIRL Bruno DUVAL) can under no circumstances be held responsible for this change in the place of delivery decided by our service providers.
For reasons of cost, speed, quality of service and acceptance of weights/volumes by the carriers, MON SIEGE A MOI ( EIRL Bruno DUVAL) reserves the right to use a different carrier than the one announced at the time of the order.
Chairs and accessories can be delivered in many countries. If no shipping options appear, after you have identified yourself, you can contact us for a personalized quote and the amount of shipping costs.
Different delivery methods are available to the customer depending on the product ordered:
By so-colissimo: 48 to 78 hours* from Monday to Saturday at home, shopkeeper or post office
By Chronopost: 24-hour delay (home delivery or relay point) from Monday to Saturday
By courier (SCHENKER, FEDEX, GEODIS): 48 to 72 hours*, by appointment from Monday to Friday, delivery against signature

The chairs are delivered prepared in accordance with the requirements of European legislation applicable in France.
On the day of shipment you receive an email notifying you of the departure of your order and in the case of a delivery of a chair with an appointment the carrier will contact you to agree on a delivery date.
In the event that the buyer is absent when a chair is delivered after an appointment has been made, it is the buyer's responsibility to contact the carrier to arrange a new delivery or to pick up his order at the carrier's depot. In the event of absence from the agreed schedules, the Internet user must approach the carrier as soon as possible and inform him/her of this.
Failing this, the representation costs will be invoiced, if necessary, by MON SIEGE TO ME ( EIRL Bruno DUVAL).
In the event of a change of delivery address, any management fees that may be requested by the carrier will be charged to the customer.
In the case of delivery of accessories to the home via So Colissimo, a delivery notice is left in the mailbox in case of absence and the package can be collected at the post office within 10 days; it is also possible to choose a relay delivery package. If the package is not collected within 10 days and is returned to MON SIEGE AT MON SIEGE ( EIRL Bruno DUVAL), the costs of reshipment of the product are at the expense of the buyer and requested before the package is sent.
Check the package upon receipt before signing!
Upon receipt of the package, check the package in front of the delivery person (packaging and contents).
In the event that one or more of the products ordered are missing, defective or damaged, the customer or recipient must make written reservations with the carrier at the time of delivery. To be admissible, these reservations must be clear and precise and provide information on the condition of the goods and not on the packaging ("damaged chair", "broken fork", "damaged paint" and not "damaged package", "damaged packaging"). Any reservation referring to a subsequent verification by the recipient ("subject to control", "subject to unpacking") is inadmissible.
If the package is damaged, torn, opened you must refuse the package and contact our services to inform us by phone or electronically. After receipt of your package by our services, depending on the nature of the product, the stocks available and according to your wishes, we will offer you to reship the product initially ordered, an exchange product or the possibility to cancel your purchase.
In the event of defective or missing items, make your remarks immediately on the slip presented to you before signing it, specifying the condition of the product, especially if it is damaged.
If the delivery person refuses to wait until the product is completely unpacked, please specify this on the slip before signing it.
In the event of damage noted after delivery in accordance with the legal provisions, it is your responsibility to hold the carrier liable by registered letter with acknowledgement of receipt within 72 hours (excluding public holidays) following receipt. It is then essential that you describe precisely the type of damage found and why it was not detectable during the inspection upon receipt. Some shocks are only visible when the power is turned on, for example.

The Client's failure to issue any hardcore reservations means that the product delivered is deemed satisfactory and may not be the subject of any subsequent dispute.
Attention: the reserves must be characterized; the mention "subject to unpacking" does not constitute a characterized reserve and has NO LEGAL VALUE.
For ecological reasons, MON SIEGE MON SIEGE ( EIRL Bruno DUVAL) may use re-used cardboard boxes in order to send goods. Don't be surprised. MON SIEGE A MOI ( EIRL Bruno DUVAL) endeavours to package the product in the most appropriate way to ensure delivery under the best conditions.
* SPECIFIC INFORMATION RELATED TO DELIVERY OUTSIDE METROPOLITAN FRANCE:
the shipping price indicated on your order may be subject to variations depending on the shipping conditions specific to the chosen delivery address, which in some cases cannot be known in advance. If, for example, the actual final price of the transport is much higher than that indicated on the order, MON SIEGE ( EIRL Bruno DUVAL) may ask the customer for an additional payment.
Please note: for customers outside the European Union and for customers residing overseas, customs may have to charge import taxes/sea grants/taxes. These costs are not included in our shipping costs. We recommend that you check with customs about these costs before your order so that you are not surprised when the package is received.
In the case of an order outside metropolitan France, in particular for a chair, we advise you to contact us by email so that we can make a precise quotation to our carrier.
9. CARRIER STRIKES
In the event of a strike by our carriers' services, or any other exceptional event slowing down or preventing the delivery of your order, MON SIEGE A MOI ( EIRL Bruno DUVAL), will do everything in its power to inform the customer of the status of the shipment of his chair and/or accessories, but cannot be held responsible for any delays caused.
Are considered as force majeure relieving the seller of his obligation to deliver, war, riot, fire, strikes, accidents, traffic restrictions and the impossibility of being supplied. The seller will keep his customer informed in a timely manner of the cases or events mentioned above.
10. DELAY
The chairs are in stock or for custom-made chairs their manufacture is launched when the order is validated.
The average preparation time for a product in stock varies from 1 to 10 working days, excluding exceptional events. To this deadline is added a variable delivery time depending on the selected mode of transport.
The average manufacturing time of a chair is indicated in working days on the product sheet before placing the order. Please note: this time limit does not take into account closures for annual leave.
If the delay is not indicated, the mention "delay: ask us" appears; we invite you to consult us so that we can communicate a delay before you validate the order.
When the chair you ordered is put into production at the factory, the factory informs us of its production times. We will then send them to you by e-mail.
In the event of immediate unavailability of an ordered accessory, you will be informed as soon as possible by e-mail via your online customer account. A possible replenishment time is then communicated to you.
If you consider the delivery time of the chair or accessory too long you can choose to cancel the order within 7 days of the email indicating the delivery time. If the order has been paid and the debit is effective, you will be refunded within 14 days of exercising your right.
In the event that the seven-day delivery deadline for the product is exceeded, and if this is not due to force majeure, you may cancel your order by simple letter or by e-mail to your customer account.
If you cancel an order validated more than 7 days ago for a chair and this order is being manufactured, while the announced deadline has not been exceeded by more than 7 days, 10% of the amount of the order will remain due by the customer to cover the management costs.
11. RIGHT OF WITHDRAWAL
In general, the right of withdrawal applies to any contract of sale or provision of services concluded away from a business establishment.
In accordance with the provisions of Article L. 121-20 of the Consumer Code, the consumer has, as from the receipt of the goods, a period of 14 clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs, which remain the responsibility of the buyer. When the 14-day period expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day.
In accordance with Article L. 121-21-8 of the Consumer Code, this withdrawal period does not apply to the purchase of products made to the buyer's specifications or clearly personalised, which is the case with custom-made chairs.
Excluded from the scope of the right of withdrawal are contracts for the supply of goods made to consumer specifications or clearly personalised, such as a made-to-measure armchair.
Also excluded from the scope of the withdrawal period are products ordered from our showroom or collected directly from our showroom, if a verification or test is offered.
The buyer will contact MON SIEGE AT ME ( EIRL Bruno DUVAL) via the "my account" section of the monsiegeamoi.com website and select the items to be returned. MON SIEGE A MOI ( EIRL Bruno DUVAL) will confirm the withdrawal request to the customer by sending an electronic message.
The product(s) must be returned in perfect condition in their original packaging with the return document that you can print from your customer area. They will then be exchanged or refunded on the basis of the purchase price deducted from any shipping costs.
In the event of non-compliance with these conditions, MON SIEGE A MOI ( EIRL Bruno DUVAL) reserves the right to refuse the exchange or refund.
The buyer is free to choose the shipping method of his product and to subscribe or not to subscribe to an insurance in case of loss, theft or destruction of his package. MON SIEGE MON SIEGE ( EIRL Bruno DUVAL) do not bear any of these costs or the cost of transport and cannot be held responsible for the non-receipt of the buyer's package. In general, all costs and risks associated with the return of the product are the responsibility of the sender.
Only products returned complete, in perfect condition, in their original packaging and with a return document will be accepted. Otherwise, the return will be considered as a non-compliant return and will not be refunded by MON SIEGE TO ME ( EIRL Bruno DUVAL).
The refund will be made within 14 days of the date of receipt of the products by MON SIEGE A MOI ( EIRL Bruno DUVAL). In case of payment by credit card, the refund is made directly to the credit card. In case of payment by cheque, the refund is made by cheque, sent to the billing address. In the case of payment by bank transfer, the refund is made by bank transfer.
In the event of a partial return of an order, MON SIEGE A MOI ( EIRL Bruno DUVAL) will refund the customer the amount of the item(s) returned, excluding shipping costs. In the event of a total return of an order, MON SIEGE A MOI ( EIRL Bruno DUVAL) will reimburse the customer for the total amount of the one-way shipping costs paid at the time of the order.
Attention: in accordance with the Consumer Code Article L121-20-2 and the European Directive of 20 May 1997 Article 6-3 are excluded from the scope of the right of withdrawal contracts for the supply of goods made to the consumer's specifications, such as custom-made chairs My Own Seat.
Attention: if you cancel an order validated more than 7 days ago for a customised chair (excluding customised chairs), if this order is being manufactured and the announced delivery time has not been exceeded by more than 7 days, 10% of the amount of the order will remain due by the customer to cover management costs.
12. DEFECTIVE OR NON-COMPLIANT PRODUCT
If the product is defective due to transport, refer to article 6 Delivery, "Check the package upon receipt before signing".
Any complaints, as to apparent defects or non-conformity of the delivered product with the ordered product or the consignment note, must be made in writing within 14 days of the date of receipt of the goods by the customer.
It will be up to the customer to provide any justification as to the reality of any defects or anomalies noted.
The customer must allow us all facilities to identify any defects so that we can remedy them.
The customer shall refrain from any internal technical intervention on the equipment that may be involved, this clause applying all the more to any third party, even if mandated by the customer.
If the article received does not correspond to the product ordered, the buyer has 14 days from receipt of the package to make a request for return to MON SIEGE A MOI ( EIRL Bruno DUVAL) via the "my account" section. The item will then be returned or exchanged within 14 days of receipt. The item(s) will be returned in perfect condition in their original packaging, accompanied by the return document sent by MON SIEGE A MOI ( EIRL Bruno DUVAL).
In the event of delivery of a non-compliant product, the return costs are the responsibility of the company.
13. OWNERSHIP
MON SIEGE A MOI ( EIRL Bruno DUVAL) retain ownership of the products ordered until full and effective payment of the order has been received. The customer becomes responsible for the product upon receipt.
14. WARRANTY
Regardless of the commercial guarantee, monsiegeamoi.com remains bound, for all products sold on its website, to apply the legal guarantees of conformity (articles L.211-4 to L.211-14 of the Consumer Code) and hidden defects (articles 1641 to 1649 of the Civil Code) under the conditions provided by law (for more information click here).
"Legal guarantee of conformity" (excerpt from the Consumer Code)
Art. L.211-4. "The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where the latter has been charged to him by the contract or has been carried out under his responsibility.
Art. L.211-12. "The action resulting from the lack of conformity shall be barred after two years from the date of delivery of the goods".
Art. L.211-5. "To be in conformity with the contract, the property must:
1 "Be fit for the use usually expected of a similar property and, if applicable:
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- have the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer or his representative, in particular in advertising or labelling. »
2. "Present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. »
Guarantee against hidden defects (excerpt from the Civil Code)
-Art. 1641. "The seller is bound by the warranty for hidden defects in the thing sold that make it unfit for the use for which it is intended, or that reduce this use so much, that the buyer would not have acquired it, or would have given only a lower price, if he had known them. »
-Art. 1648 - paragraph 1." The action resulting from the fundamental defects must be brought by the purchaser within two years of the discovery of the defect. »
-Art. 2232 of the Civil Code "The postponement of the starting point, suspension or interruption of the limitation period may not have the effect of extending the period of limitation beyond twenty years from the day on which the right arises. The first paragraph is not applicable in the cases mentioned in articles 2226, 2227, 2233 and 2236, in the first paragraph of article 2241 and in article 2244[of the same Code]. Nor does it apply to actions relating to the status of persons. »
In this case, the client is reminded that he must act within "a short period of time" from the discovery of the hidden defect (article 1648 of the Civil Code) and provide proof of the existence of such a defect. Some products sold on the site benefit from a commercial guarantee whose duration is mentioned on the product page of the articles concerned. The commercial guarantee covers parts, excluding labour and transport costs.
This warranty will not apply in the event of a problem caused by negligence, damage or improper use of the product. Any modification made to the cycle outside our workshops or without our prior written consent will void the warranty (for example, the installation of an unsuitable motorization system that could weaken the frame of the cycle).
As part of the warranty, MON SEAT A MOI ( EIRL Bruno DUVAL) offers to the buyer either to bring his product to the showroom MON SEAT A MOI ( EIRL Bruno DUVAL), or to return his product to monsiegeamoi.com. The payment of shipping costs will be made under the conditions provided for by law, regardless of the solution he has chosen.
In general, for the implementation of these guarantees:
The customer has a period of 2 years to act from the delivery of the goods.
The customer may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 217-17 of the Consumer Code.
The customer is exempted from having to provide proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the goods.
The legal warranty of conformity applies independently of the commercial warranty.
The customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between cancelling the sale or reducing the price in accordance with article 1641 of the Civil Code.
The customer is expressly informed that the company is not the producer of the products presented within the meaning of the law.
